Ogg, Murphy and Perkosky (OMP) is pleased to announce the results of a verdict entered on behalf of our clients on February 27, 2023, in the matter of the stillborn death of Lucy Ava Lathom in the case of Lathom v. Heritage Valley Health System. After an eight-day trial, where the jury heard sixteen witnesses, including experts in obstetrics, pediatric pathology, maternal fetal medicine, and forensic economics, the jury entered a verdict in favor of the Plaintiffs and against all Defendants, including Heritage Valley Health System. The jury awarded $10,000,000 in Wrongful Death damages to Lucy’s parents and $1,035,000 in future wages, and $5,000,000 for pain and suffering to Lucy’s estate. Plaintiff also has filed a motion for almost $3,000,000 in delay damages as a result of the verdict. The verdict was reported in several publications and is captioned Lathom v. Heritage Valley Health System, et al., No. 11050 of 2018, Common Pleas Court of Beaver County, Pennsylvania. The Lathoms were represented and at trial by OMP attorneys John D. Perkosky and Michael A. Murphy.
